General Terms and Conditions of Didamed Verlag GmbH

§ 1 Scope of the Terms and Conditions

The deliveries, services, and offers provided by Didamed Verlag GmbH are governed by these Terms and Conditions, which also apply to all future business relationships, even if they are not expressly agreed upon again. The terms and conditions in effect at the time of the order shall apply. Didamed Verlag GmbH does not recognize any deviating terms and conditions of the purchaser unless Didamed Verlag GmbH has expressly agreed to their validity in writing.

§ 2 Conclusion of the Contract

(1) The terms and conditions of order and delivery set forth herein shall apply.

(2) You can place an order online, by email, by phone, or by mail.

(3) Unless you return the ordered product within the 10-day inspection period following delivery, the purchase contract is concluded. We do not store the text of the contract.

§ 3 Terms of Delivery

(1) Shipping: The publisher generally ships orders within three business days of receiving the order. Single items are shipped within Germany via Deutsche Post; multiple books are generally shipped via insured Hermes package. If ordering multiple books, the customer must provide a phone or cell phone number for the courier service so that the books can still be delivered promptly even if the customer is not home. The publisher guarantees that this customer information will be made available exclusively to the courier service and not to any third parties for purposes such as advertising or similar.

(2) Within Germany, the publisher bears the shipping costs for delivery to the customer. Additional shipping costs apply only for deliveries outside Germany; these are tiered based on the country and distance (see Shipping and Payment Terms). The customer is responsible for any costs associated with returning the item to the publisher.

(3) Returns Due to Damage During Shipping: If your order is delivered with damage caused during shipping, please send photographic documentation of the damage to the packaging and contents to the publisher via email within three days of the delivery date so that a claim for the damage can be filed with the postal service / DHL / Hermes in a timely manner. Before making any return (please do not send the package collect; instead, ship it prepaid at the buyer’s expense), please contact the publisher by phone or email. Thank you very much.

(4) Digital eBooks or eBook chapters are individually personalized and must be downloaded by the customer promptly after placing the order and saved digitally on suitable storage media by the customer, because the right to download is time-limited and remains valid only until a new edition of the same book title is published. Upon the publication of the new edition, the right to re-download the material from the previous edition and to stream the accompanying videos for that previous edition automatically expires.

Right of Withdrawal Policy

(5) Return Policy for Print Copies: If you are not satisfied with one or more book titles, you are guaranteed the right to return printed books within 10 days of delivery, even without providing a reason. To meet the deadline, it is sufficient to send the ordered books, along with the original invoice, in a timely manner and postage-paid to Didamed Verlag GmbH, Robert-Mayer-Weg 18, 40591 Düsseldorf. The customer is responsible for the postage costs for returning the items to the publisher and bears the burden of proof for the shipment of the returned goods. No other costs are incurred in connection with the return or cancellation of the order.

Any purchase prices already paid for returned shipments will be refunded within 30 days of the publisher’s receipt of the return, provided that the ordered merchandise arrives at the publisher in resalable condition, without damage or signs of use. Therefore, when returning an item, please ensure that it is adequately packaged to protect against impact and that sufficient postage is provided. However, if the return is sent collect, the publisher is entitled to deduct the resulting postage costs from the refund amount.

(6) Cancellation Policy for Digital eBooks: Since, by their very nature, these products cannot be effectively returned after download due to copy protection and restrictions on further use, the customer, by placing an order, agrees to waive their right of cancellation or return pursuant to Section 312d of the German Civil Code (BGB). Digital eBook chapters or books, as well as access to accompanying videos, are purchased only for the duration of the edition acquired. Upon the release of a new edition, the right to re-download the previous edition expires.

§ 4 Payment

Your order is binding. The delivered products remain the property of Didamed Verlag GmbH until full payment has been made. For private individuals, delivery is made via direct debit through Micropayment or PayPal without any discount. In the event of a payment delay—for example, if the bank of the purchaser does not honor the direct debit—all of the purchaser’s outstanding orders become due immediately, and the publisher is entitled, in the case of private consumers, charge a processing fee of €3 per individual order in addition to late payment interest at a rate of 5% above the statutory base rate. For business customers, the flat-rate processing fee is €40 plus 9% interest on arrears above the statutory base rate. If the customer fails to pay the amount due in full or at all, despite a payment reminder and a set deadline, the customer shall bear the costs of the collection proceedings and any legal action.

§ 5 Prices, Price Changes

(1) The prices and taxes specified at the time of the order shall apply for billing purposes.

(2) Shipping costs and sales tax are included in the price for deliveries within Germany. For information on additional costs for international deliveries outside Germany, please refer to the Shipping and Payment Terms page.

§ 6 Warranty and Liability

(1) Any defects in the ordered product must be reported to Didamed Verlag GmbH immediately upon receipt, but no later than three calendar days after delivery, in writing or by email, including a photo of the damage to the packaging. The defective items must be kept available for inspection by Didamed Verlag GmbH in the condition they were in at the time the defect was discovered. If the publisher is responsible for the defect—for example, due to improper packaging—subsequent performance will be provided.

(2) Claims for damages arising from a positive breach of contract, from fault in the conclusion of the contract, or from a tort are excluded both against Didamed Verlag GmbH and against its agents or vicarious agents, unless the damage was caused intentionally or through gross negligence.

(3) Liability for other damages incurred by the purchaser as a result of a delay, an impossibility for which Didamed Verlag GmbH is responsible, or a breach of an obligation whose fulfillment is of particular importance for achieving the purpose of the contract, is limited to damages that are typical and foreseeable based on the contractual use of the goods.

(4) Any further liability—in particular for damages not incurred to the goods themselves, for lost profits, or for other financial losses suffered by the customer—is excluded.

§ 7 Copyright

Copyright and all publishing and intellectual property rights to the delivered products are held by Didamed Verlag GmbH. The transfer of a personalized, digitized eBook to third parties would result in liability for damages. Any other commercial reuse or reproduction of the texts and photos is also prohibited. This applies to all products and the entire website of Didamed Verlag GmbH.

§ 8 Final Provisions

(1) If any of the foregoing terms is not (or is no longer) compatible with statutory provisions, the remaining terms shall nevertheless remain valid, and a provision that complies with the law and most closely approximates the provision set forth herein shall take effect.

(2) The place of jurisdiction and performance shall be Düsseldorf, unless another place of jurisdiction has been agreed upon in writing or the law mandatorily prescribes otherwise: For all disputes arising from the business relationship between us and our customers, if the customer is a registered merchant, a legal entity under public law, or a special fund under public law, the action must be brought before the court with jurisdiction over our headquarters. We are also entitled to bring an action at the purchaser’s principal place of business. If the purchaser has his domicile or habitual residence abroad, Düsseldorf shall be the place of jurisdiction for all claims arising in connection with the order.

(3) German law applies exclusively. The UN Convention on Contracts for the International Sale of Goods is excluded, even if orders are placed from abroad or delivered abroad.

(4) By placing your order, you agree to be bound by the above terms and conditions.
